- HK, your fair use discussion was definitely very creative. I'll give you that. But fair use has an actual meaning. For the analysis to even begin, we'd most likely be talking about Kool-Aid, not something completely unrelated. The PTO has a brief list of criteria that comes from many years of caselaw under the Copyright and Lanham Acts. Have a look. Likewise, there's no non-frivolous basis for using the words "Kool Aid" under the circumstances. Sorry buddy. 23:02, 27 December 2012 (UTC)
