This is a comment on points made by Tisane in his essay on Adult-Child sex. I believe showing points to be flawed is better than just an emotional reaction.
It can be assumed that "child-adult sex," without any other qualifiers, refers to child-adult sex in which the child did not express dissent in any manner, or (if you prefer) the child expressed consent in some manner.
- did not say no is not the same as consent. I believe courts have riled before in rape cases where the woman was not able to object (drunk, drugged etc)
This would be similar to how, if we were discussing the pros and cons of cannabis use, we would assume that the cannabis use was consensual; we would not lump into that discussion,...
- This raises an issue of informed consent. Does the person understand what they are being asked to do, do they understand the outcome ? A person who does not understand what is being asked cannot reasonably be said to have given informed consent. an example might be to ask your wife/girlfriend "would you like to see a goatse ?" if she mistakenly thinks its like a horsie but with a goat you may have consent , but also likely a punched head.
..unless it can be shown that all child-adult sex is necessarily coerced
- I would suggest that child-adult activities are never entirely consensual depending on the relationship since the adult is normally an authority figure. How often does a child get asked "do you want to go to the grocery store ?" instead of "I am going grocery shopping, get in the car now ! " ?
Burden of proof
- I suggest US law in many areas requires those promoting an activity to demonstrate its safety. Amusement park rides, legal drugs, food preparation, cars, etc all require an approval process which require safety standards.
Costs of criminalizing child-adult sex
- you could claim the same costs for killing your spouse with possibly better statistics.
- if society did cost-benefit on criminal prosecution lots of crimes could not reasonably be prohibited. Does society want rapists, burglers, car theives, people who kill their own kids to be at large ?
If the behavior is victimless
- thats a big if ?
Since we cannot compel parents to offer the gifts and affection without asking anything in return, the alternative, if we want the child to have those things, is to permit him to trade for them.
- I would suggest giving affection is sufficient a trade. "Here is a toy unicorn, now bend over I want to fuck aqyou up the ass" is not a conversation I would expect in any household with children involved.
(e.g. time, effort, etc. involved in acquiescing to what is requested of him).
- hmm aquiescing, interesting word choice. "Accept something reluctantly but without protest" is one definition. That does not sound like consent to me.
stray thoughts[edit]
I find most of the reasoning in this essay to be questionable if not self serving to promoting the title viewpoint. I am not aware of sexual activity between any pre-pubecent children beyond the "show me yours and I'll show you mine" curiosity.
perhaps I am just too old , but I always believed that it was only after puberty that children could get gratification from sexual activity in terms of genital stimulation.
