However if the accused is able to show (and the onus is on him) that he has that amount for his personal use (ie he smokes a lot of weed) then he can escape with just a possession charge.

I know it seems sensible (objections to shifting the burden of proof aside), but it still makes for an awkward argument. "No, no, I'm a completely different kind of reprehensible person!
