RationalWiki really can't make fair use claims. Wikipedia can as an educational project of the non-profit Wikimedia Foundation. This and everything tagged with it really need deletion.--Ipatrol 23:13, 16 April 2009 (EDT)
- Not all fair use is educational. There are 4 things considered under law when deeming something fair use:
- the purpose and character of the use, including whether such use is of commercial nature or is for nonprofit educational purposes;
- the nature of the copyrighted work;
- amount and substantiality of the portion used in relation to the copyrighted work as a whole; and
- the effect of the use upon the potential market for or value of the copyrighted work.
- "we are using it for education so it is fair use" can at times be more bullshit than "we are using it for a laugh". Things such as parody (of the work and of a third party), satire and commentary are also covered under fair use. We have policy: if the copy-right holder complains we will take it down, most of the time. - User 23:19, 16 April 2009 (EDT)

- I think Ipatrol has bought into the CP myth that because you are trying to make something educational (how many students is Wikipedia invested to teach? I know Andy has a few dozen school students) that any image they use if fair use and everyone else is breaking copy-right. - User 00:41, 17 April 2009 (EDT)
