But a lot of the great stuff out there is in features or direct to video stuff, not in the series work that you hear the fangirls go on about. I run my computer into a 1977 Kenwood receiver and out into two Sony bookshelf speakers. It sounds great, and my downstairs neighbours really seem to love it when I play my music with the receiver turned up over 4 or 5. I can hear them banging on the ceiling in appreciation. All this was running through a computer which in turn ran through into some massive JBL speakers so we could manipulate the music, add effects and record mixers. - Oh for goodness sakes. Not even the far far right think this is a good idea. The statute proposes to limit the jurisdiction of all federal courts from adjudicating any claim involving a state or local law relating to free exercise or establishment of religion, any claim based on right of privacy (remember that this is one of those "penumbra" rights that the far right hates, stemming if IIRC from Griswold v. Conn. = the rubbers case) "including any such claim related to any issue of sexual practices, orientation, or reproduction," and any equal protection claim based on straight or gay marriage. Further, the Supreme Court and all federal courts would be prohibited from relying on any earlier federal decision on the above topics (Ron Paul wants to completely rewrite federal constitutional jurisprudence - I have no words for how appalling I find this idea).
A "violation" of the Act by a judge would be an impeachable offense, and the Act retroactively removes all cases decided on issues that would have been prohibited by the Act from the principle of stare decisis.
I've been meaning to look at whether Congress would even have the constitutional authority under any empowerment clause in the constitution, particularly in the context of limiting the Court's authority to hear certain habeus corpus cases involving detainees. - Turns out only parts of the We the People Act are remarkable. It was a surprise to me to remember that Congress actually does have the authority to limit the jurisdiction of all courts lower than the Supreme Court and to limit all but the original jurisdiction of the Supreme Court (original means not appellate). What's more remarkable about this statute are the theoretical consequences of prohibiting the Supreme Court from reviewing past authority. - It's a little more complicated, but you're basically right for the kinds of cases that matter. Courts in the United States, whether under state or federal law, are created and empowered by statutes or constitutions. In the federal system Article III of the United States Constitution creates the Supreme Court and specifically determines its jurisdiction. Jurisdiction is the power of a court to adjudicate a particular matter. In the context we're talking about here, we're talking about "subject matter" jurisdiction, or the power of a court to adjudicate certain kinds of matters, rather than "personal jurisdiction," which is a court's power over a particular person or entity. The Supreme Court has what is called "original" subject matter jurisdiction over only a small category of cases, including "all cases affecting ambassadors, other public ministers and consuls, and those in which a state shall be party." These cases are an insignificant part of the Court's work, both in number and significance. Original jurisdiction means these cases can be filed directly in the Supreme Court with it acting as both finder of fact and law. Without altering the Constitution, no act of Congress could diminish this "original" jurisdiction because such acts are subordinate to the Constitution. The Supreme Court also has "appellate" jurisdiction over narrowly defined categories of cases " with such exceptions, and under such regulations as the Congress shall make." Appellate jurisdiction is the Court's power to sit in review of decisions of lower federal courts and state supreme courts on important issues (it's purely discretionary and in fact the Court hears a smaller and smaller percentage of all appeals filed every year). This means that Congress has the power to define anything but the Court's original jurisdiction. Article III also gives Congress the authority to establish the lower courts, which are the Circuit Courts of Appeal and the District Court (trial courts). The trial courts are where all federal cases start. The We the People Act would end trial court jurisdiction over the above types of cases, as well as preclude the Supreme Court from hearing appeals on these types of cases. It's crooked, would be unlikely to pass, but parts of it are theoretically not unconstitutional. As Congress has the power to create these courts, Congress also has the power to constrain their jurisdiction and there are several examples of this happening in American history, particularly during the Civil War. 03:07, 11 August 2009 (UTC)
